GENERAL PROVISIONS
1. Concepts
1.1. The seller (data controller) – the electronic store baldufabrikas.com belongs to the company UAB “Dzūkijos baldų fabrikas”.
1.2. Buyer – a natural or legal person who ordered the product(s) in the e-shop baldufabrikas.com.
1.3. The rules for the purchase and sale of goods (hereinafter – the Rules) determine the rights and obligations of the Buyer and the seller (UAB “Dzūkijos baldų fabrikas”), the prices and payment terms of the goods, the delivery and return procedure, the warranty terms and other responsibilities.
2. The moment of concluding a distance contract of purchase and sale
2.1. The agreement between the Buyer and the Seller is concluded after the Buyer has formed a basket of goods, as well as after filling in the delivery data and clicking on the item (s) to order, and when the Seller contacts (by phone or e-mail) with the Buyer discusses additional needs, prices, conditions and agrees on the confirmation of the order for the product (s).
2.2. The purchase – sale agreement can also be concluded remotely by directly contacting the Seller by messenger, phone or e-mail.
3. Buyer’s rights
3.1. The buyer has the right to order goods in the e-shop baldufabrikas.com, following these and other rules established in the places of information of the e-shop.
3.2. The Buyer has the right to request the erasure, correction of incorrect or inaccurate personal data of himself/herself by contacting the Seller in any way. The seller must immediately implement the buyer’s request.
3.3. The buyer has the right to withdraw from the purchase-sale contract if the seller does not fulfill the agreed conditions on time or cannot fully fulfill the conditions.
4. Obligations of the buyer
4.1. The buyer must pay for the product(s) and additional services, as well as accept the product(s) in accordance with these rules.
4.2. If the buyer’s data changes, he must update them immediately or notify about the changed data.
4.3. The buyer undertakes to comply with these rules and the requirements established by the legal acts of the Republic of Lithuania.
4.4. If the Buyer wants to change the conditions of product production or delivery, he can contact the Seller in any form and discuss. If the Seller agrees to change the terms and conditions, it is possible with an additional payment of the Buyer.
4.5. By ordering goods, the Buyer agrees that the personal data provided by him will be processed for the purpose of buying or selling goods.
5. Seller’s rights
5.1. If the Buyer tries to damage the stability and security of the electronic store, violates his obligations, the Seller has the right to limit or terminate the possibility to use the electronic store services without warning.
5.2. The seller has the right to restrict the possibility of using the services of the e-shop without prior notice.
5.3. If the Seller is unable to complete the order on time or in full, he has the right to change the terms and conditions immediately after notifying the Buyer, and if the Buyer does not agree to the change of terms, to return the payment if the Buyer has paid for the item(s).
6. Obligations of the seller
6.1. The seller undertakes to create conditions for the buyer to use the baldufabrikas.com services of the e-shop.
6.2. If the Seller is unable to produce the desired item for the Buyer, he undertakes to offer the Buyer an analogous item, and if the Buyer refuses to return the money within 14 days. In this case, the Seller is released from responsibility for not providing the product(s) to the Buyer.
7. Product quality guarantee
7.1. The general characteristics of each product are presented next to the description of each product, the specific characteristics of the product (s) are discussed when the Seller contacts the Buyer at the time of ordering.
7.2. The seller is not responsible if the colors, shape, size of the product differ from the photos in the online store due to the specifications of the monitor used by the buyer.
7.3. In the e-shop baldufabrikas.com, all furniture is provided with a 24-month warranty.
8. Product prices, payment and delivery/collection procedure
8.1. In the electronic store baldufabrikas.com, the prices are indicated in euros.
8.2. Payment procedure:
8.2.1. Payment by bank transfer;
8.2.2. Payment in cash upon arrival at the company;
8.3. The Seller has the right to demand a partial advance payment from the Buyer.
8.4. The VAT invoice indicates the goods, the quantity, if there are discounts, the final price, taxes, other data required by accounting legislation.
8.5. Delivery of goods is possible for an additional fee. Delivery requirement and cost are discussed at the time of ordering the item(s).
8.6. The buyer can pick up the goods in the warehouse for free. Pick-up of the product(s) is required no later than within 5 working days from the confirmation that the order of the item(s) is ready for pick-up.
8.7. The buyer must check the quality and quantity of the product(s) when accepting the goods. If the Buyer notices a violation of the product (s) or other inconsistencies, the Buyer has the right not to accept the goods, and the seller must correct the violations or other discrepancies.
8.8. After the buyer accepts the product(s) without complaints, it is considered that the condition, quantity and quality of the product(s) meet the conditions of the purchase-sale agreement and additional services.
8.9. The Seller is exempted from liability in all cases if the product (s) are not provided at all or are not delivered on time due to the fault of the Buyer or the circumstances belonging to the Buyer.
8.10. Furniture can not be delivered unassembled.
9. Return and exchange of goods
9.1. The goods are made according to the Buyer’s individual order, so they are not returnable.
9.2. The goods are manufactured according to the Buyer’s individual order, so they are not exchangeable.
10. Responsibility
10.1. The Buyer is responsible for the accuracy of the data provided in the baldufabrikas.com order form, as well as the Buyer assumes responsibility for the consequences of this data, which were caused by the inaccuracy or falsity of this data.
10.2. The buyer is responsible for the actions that are performed using the e-shop baldufabrikas.com.
10.3. The Seller is not responsible for the information provided on the websites of other companies or organizations. The Seller shall not be liable even in cases where the Buyer enters these websites through the links on the Seller’s website.
11. Sending information
11.1. The seller sends messages to the buyer by the e-mail specified in the order form, he can communicate by phone or messenger.
11.2. The Buyer sends messages or questions to the Seller using the means of communication specified by the Seller (sales@baldufabrikas.com, +370 610 62040 or messenger).
